General Terms of Sales<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

1. Scope of Application<\/strong><\/p>

These general terms and conditions apply to all training courses offered by ITTA (IT TRAINING ACADEMY SA), whether held on ITTA premises or at external locations. Certain course categories may be subject to specific conditions explicitly stated. <\/p>

These general terms also apply to specific conditions, unless expressly stated otherwise. They take precedence over any other general or specific terms from the Client, unless otherwise agreed in writing by ITTA. <\/p>

The parties to the agreement are the natural or legal person placing the order (hereinafter: the \u201cClient\u201d) and IT TRAINING ACADEMY SA (hereinafter: \u201cITTA\u201d). The \u201cParticipant\u201d refers to the individual who attends the course. The Client guarantees that the Participant accepts and adheres to these terms. <\/p>

No modification to this Agreement shall be valid unless made in writing and signed by authorized representatives of both parties.<\/p>

2. Course Offers<\/strong><\/p>

The website www.itta.net<\/span> constitutes the official source of standard course offers, including catalog trainings, programs for job seekers, virtual classroom courses and e-learning solutions.<\/p>

All published offers (online or printed) are provided for information purposes only and may be modified at any time without notice. ITTA shall not be held liable for any errors or omissions. <\/p>

3. Order and Registration<\/strong><\/p>

Any order or registration is subject to ITTA\u2019s acceptance. A contract is deemed formed upon written confirmation by ITTA or upon execution of the Client\u2019s order. Only documents signed or emails issued by ITTA have contractual value. <\/p>

Registrations may be submitted by mail, email, or via www.itta.net<\/span>. A Confirmation Email will be sent to the Client, and a personalized invitation will be sent to the Participant(s). An invoice will follow, stating the payment deadline. <\/p>

Unless otherwise agreed, registration becomes effective upon receipt of payment within the indicated period. For Clients benefiting from deferred payment terms, written confirmation by ITTA constitutes a firm registration. <\/p>

4. Course Prices<\/strong><\/p>

Prices listed in course descriptions include instruction, stated materials, on-site services (WLAN, coffee breaks, etc.), and access to IT equipment. Travel, accommodation, and meal expenses are borne by the Client. <\/p>

Any additional fees (licenses, exams, etc.) may be invoiced separately.<\/p>

5. Value Added Tax (VAT)<\/strong><\/p>

Unless otherwise stated, all prices are exclusive of VAT. The applicable Swiss VAT will be added to all invoiced services. <\/p>

6. Cancellation or Postponement of Registration<\/strong><\/p>

6.1 Initiated by the Client or Participant<\/span><\/p>

All cancellations or postponements must be submitted in writing and confirmed by ITTA.<\/p>

  • Up to 21 calendar days before the start date: 0% fee<\/li>
  • Between 21 and 15 calendar days: 25% of the course price<\/li>
  • Between 14 and 8 calendar days: 50% of the course price<\/li>
  • Less than 7 working days or no-show: 100% of the course price<\/li><\/ul>

    These fees remain fully due even if invoicing occurs after the course.<\/p>

    In case of non-payment, ITTA reserves the right to pursue legal action to recover the amounts contractually owed.<\/p>

    No refund or reduction shall be granted in case of absence or course interruption, unless in proven force majeure situations. In case of valid justification (e.g. serious illness or accident), ITTA may, at its sole discretion, propose a postponement. <\/p>

    A substitute may attend the course at no additional charge, provided the full course is covered. For trainings requiring prior assessment, replacement is subject to validation. <\/p>

    <\/p>

    6.2 Initiated by ITTA<\/span><\/p>

    ITTA reserves the right to postpone a session due to an insufficient number of participants or other legitimate reasons.<\/p>

    In such cases, the Participant\u2019s registration will be automatically transferred to the next equivalent session (same format, schedule, location, and price).<\/p>

    The Participant will be notified by email and has 15 calendar days prior to the new session start date to cancel or decline the registration without charge.<\/p>

    After this period:<\/p>

    • Between 15 and 7 calendar days: 50% of the course price<\/li>
    • Less than 7 working days or no-show: 100% of the course price<\/li>
    • Unreported absence or no-show: 100% of the course fee.<\/li><\/ul>

      These fees remain fully due even in the case of post-course invoicing.<\/p>

      In case of non-payment, ITTA may initiate legal proceedings to recover the contractually owed amounts.<\/p>

      7. Course Location<\/strong><\/p>

      Course venues are specified in the invitation. ITTA reserves the right to refuse to deliver a course at the Client\u2019s site if the required technical or pedagogical conditions are not met. <\/p>

      8. Trainers<\/strong><\/p>

      ITTA guarantees the presence of a qualified trainer and may employ external contractors. Any change in trainer does not constitute valid grounds for cancellation. <\/p>

      9. Course Materials<\/strong><\/p>

      Materials provided are for personal use only. Any reproduction or distribution without authorization constitutes a breach of intellectual property rights. <\/p>

      10. Quality Evaluation<\/strong><\/p>

      ITTA requires each Participant to complete a course evaluation. Complaints not submitted via this form will not be considered afterwards. <\/p>

      11. Certificate of Achievement<\/strong><\/p>

      A certificate of achievement is issued upon request, provided attendance is sufficient.<\/p>

      12. Certifications<\/strong><\/p>

      Certifications are issued by third-party publishers (e.g. Microsoft, Cisco, etc.). Exam costs are payable by the Client and must be settled before the exam date. <\/p>

      13. Schedule<\/strong><\/p>

      Day courses: 9:00 a.m. to 12:00 p.m. \/ 1:30 p.m. to 4:30 p.m. Evening courses: 6:00 p.m. to 9:00 p.m.
      The ITTA office is open Monday to Friday from 8:30 a.m. to 6:00 p.m. (except Geneva public holidays). <\/p>

      14. Attendance<\/strong><\/p>

      Participants commit to punctuality and active participation. Failure to attend may result in denial of the course certificate. <\/p>

      15. Success Guarantee<\/strong><\/p>

      Participants who meet the prerequisites but do not achieve the learning objectives may retake the same course once within 6 months, free of charge, subject to availability.<\/p>

      16. Internal Regulations<\/strong><\/p>

      Failure to comply with ITTA\u2019s internal rules may result in exclusion from the course without refund.<\/p>

      17. IT Security<\/strong><\/p>

      External storage devices are prohibited without authorization. The Client is jointly liable for any damage caused by its Participant (e.g. virus infections). <\/p>

      18. Amendments to Terms<\/strong><\/p>

      ITTA may modify these terms at any time without prior notice. Registrations already confirmed remain subject to the version in effect at the time of registration. <\/p>

      19. Non-Solicitation Clause<\/strong><\/p>

      The Client agrees not to solicit or recruit ITTA\u2019s instructors or staff during the contractual period and for 12 months after the last training session.<\/p>

      20. Insurance<\/strong><\/p>

      ITTA is covered by civil liability insurance as a private training provider. Participants must hold personal accident insurance coverage. <\/p>

      21. Limitation of Liability<\/strong><\/p>

      ITTA is not responsible for any opinions expressed during training. Its liability is limited to the invoiced value of the service, except in cases of gross negligence or willful misconduct. <\/p>

      22. Governing Law and Jurisdiction<\/strong><\/p>

      All contractual relations are governed exclusively by Swiss law. The place of jurisdiction is Geneva. <\/p>

      <\/p>

      SPECIAL CONDITIONS<\/strong><\/p>

      23. \u201cIn-Classroom\u201d Courses<\/strong><\/p>

      Courses take place as per published information, subject to minimum participant numbers. If enrollment is low, courses may proceed under adjusted conditions (reduced hours or increased cost) with participant consent. ITTA reserves the right to cancel up to 5 working days before the start. In case of final cancellation without rescheduling, fees already paid will be fully refunded. <\/p>

      24. \u201cCustom\u201d Courses<\/strong><\/p>
